Terms of sale
The terms that apply when you buy hardware through the NURV online shop — in plain English. Your rights under the Australian Consumer Law always come first.
The short version
Prices are in Australian dollars and include GST. You pay securely by card through Stripe, we issue your GST tax invoice (Stripe emails it on our behalf), and we ship Australia-wide. Risk passes to you on delivery; we keep title until you’ve paid in full. If something’s faulty or not as described, you’re covered — see our Returns & warranty policy. Nothing here takes away your rights under the Australian Consumer Law.
Who these terms are between
These terms govern the sale of hardware through the NURV online shop by NURV Consulting Pty Ltd (ABN 14 156 186 480) — “we”, “us”, “our” — to you, the customer placing the order. By placing an order you agree to these terms. Ongoing services (phone systems, internet, mobile and the like) are covered by their own service agreement, not this page.
Ordering & acceptance
When you check out, you’re making an offer to buy the items in your cart. A contract is formed when we accept your order — normally when we confirm it and dispatch the goods. We may decline or cancel an order before dispatch if, for example, an item is out of stock, there’s been a genuine pricing or description error, or we can’t verify payment. If we cancel an order you’ve paid for, we’ll refund you in full.
Prices & GST
All prices are in Australian dollars (AUD) and include GST. We issue a GST tax invoice for every order — Stripe emails it on our behalf. Shipping is charged in addition and shown at checkout before you pay. We try hard to keep pricing accurate, but if an obvious error slips through we’ll contact you before processing the order — you can confirm at the corrected price or cancel for a full refund. Prices can change at any time, but a change won’t affect an order we’ve already accepted.
Payment
Payment is taken at checkout. Card payments are processed securely by Stripe; your card details are entered on Stripe’s checkout and handled under the PCI-DSS card-security standard — we never see or store your full card number. We only dispatch once payment has cleared. How we handle the order information you give us is set out in our Privacy policy.
Delivery & shipping
We ship Australia-wide at the flat rate shown at checkout. We aim to dispatch in-stock items within a few business days of payment, and we’ll email you confirmation. Delivery timeframes are estimates from our couriers, not guarantees, and we’re not responsible for courier delays outside our control. Please give a delivery address where someone can receive the goods during business hours.
Title & risk
Risk in the goods — responsibility for loss or damage — passes to you when they’re delivered to your nominated address. Title (ownership) stays with us until we’ve received payment in full.
Cancellations & changes
Need to change or cancel an order? Contact us as soon as you can. If it hasn’t been dispatched yet, we’ll usually be able to amend or cancel it and refund you. Once an order has shipped, any return is handled under our Returns & warranty policy.
Returns, faults & warranty
If an item arrives faulty, damaged or not as described, or develops a fault, you’re covered — the details, including how to start a return, are in our Returns & warranty policy. Hardware also carries the manufacturer’s warranty.
Your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You’re entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You’re also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure isn’t major. Nothing in these terms limits or removes those rights.
Our liability
Other than the rights you have under the Australian Consumer Law and the manufacturer’s warranty (which always apply), and to the extent the law allows, our liability for any claim relating to the goods is limited to replacing the goods or refunding what you paid for them. We aren’t liable for loss that wasn’t reasonably foreseeable.
Governing law
These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction.
Changes to these terms
We may update these terms from time to time; the version published here at the time of your order is the one that applies to it.
