Acceptable use policy
What you can and can’t do with a NURV service. In one line: use it for legitimate business, don’t break the law, and don’t ruin it for anyone else.
The short version
Use your NURV services for genuine business. Don’t use them to break the law, send spam or bulk messages, attack or hack networks, or resell the service to someone else. If something goes wrong we may have to suspend or cancel the service — but for anything that isn’t urgent or unlawful, we’ll talk to you first and give you a chance to fix it.
Who and what this covers
In this policy, “we”, “us” and “our” mean NURV Consulting Pty Ltd (ABN 14 156 186 480). “You” and “your” mean the customer or end-user of our services. Anything not defined here has the meaning given in the Telecommunications Act 1997 (Cth). This policy applies to every service we provide — voice, internet, mobile and anything bundled with them — and it sits alongside your service agreement with us, not instead of it.
Use it lawfully
You must not use a NURV service, attempt to use it, or allow it to be used, in any way that:
- breaks — or involves you or us breaking — any law, order or regulation (including a foreign one), a mandatory code of conduct, or a voluntary code you’ve agreed to follow;
- could damage property or injure a person;
- harasses, menaces or stalks people;
- lets a minor access material that isn’t appropriate for them, or tries to make contact with a minor not otherwise known to you;
- unlawfully incites discrimination, hatred or violence towards a person or group — for example because of their race, religion or nationality;
- sends, publishes or distributes material that is obscene or defamatory, or that a reasonable person would find offensive or abusive;
- is misleading or deceptive in business or marketing;
- provides or promotes illegal pyramid-selling schemes, or unlawful gambling or gaming;
- infringes our rights or anyone else’s (including intellectual property and moral rights);
- misuses our confidential information or anyone else’s; or
- breaches any other obligation you owe to another person.
Don’t abuse the network
Use the service as much as you like — just don’t use it to attack the network or anyone on it. You must not:
- interfere with the proper operation of the service, or any part of our network or systems;
- access our systems, networks or data — or anyone else’s — without consent (this includes open-relay abuse, port probing and packet sniffing), whether or not it causes any harm;
- gain, or try to gain, illegal or unauthorised access to any computer, system or network;
- create, use, develop or distribute tools designed to compromise the security of any computer, system or network;
- intentionally transmit or distribute malware — a virus, trojan, worm, cancelbot, time bomb or similar;
- take part in, or contribute to, a denial-of-service attack or any activity designed to give unauthorised control of, or harm, a computer, network or data;
- forge or alter a message — including spoofing or using third-party mail servers — to hide, obscure or fake where it came from; or
- bypass or manipulate usage limits by any means, including using multiple connections to get around a cap.
No spam or bulk messaging
You must not use the service to send:
- an unsolicited commercial electronic message that breaches the Spam Act 2003 (Cth); or
- bulk electronic messages of any kind — email, fax, SMS or MMS. We treat it as bulk when you send more than 20 messages, or a message to more than 20 recipients, within any 10-minute window.
Inclusive and unlimited calling is covered separately — see our Fair-use policy.
It’s your service, not a wholesale supply
Your service is for your own use. You must not resell or redistribute it. Where we reasonably decide use is “unreasonable” or “unacceptable” on this basis, we may suspend or cancel the service.
You’re responsible for any misuse of your service, and for taking reasonable steps to make sure all access to it is authorised by you. That includes keeping any device you connect — and the data on it — secure. If you become aware of any unauthorised access to your service, successful or attempted, please let us know straight away.
Content you put online
Publishing content on the internet can carry legal responsibilities. Please make sure you understand them before you publish anything via our network. If we suspect illegal activity, we may report it to law enforcement and disclose your personal information as described in our Privacy policy.
If you breach this policy
The rules here are in addition to — not instead of — the terms in your service agreement with us. If you breach this policy we may, depending on how serious it is, ask you to stop, suspend the service, or cancel it. For anything that isn’t urgent or unlawful, we’ll contact you first and give you a fair chance to put it right.
Changes to this policy
We may update this policy from time to time and will publish the current version here. Where a change materially restricts how you use the service, we’ll give you at least 14 days’ notice.
